This plain-language draft reflects common trailer-hire practices. It is not an approved Raeko contract and must be reviewed and adapted by the company before use. Your signed hire agreement and applicable South African law govern any confirmed rental.
From handover until Raeko accepts the trailer's return, the hirer is responsible and liable for loss, theft or damage to the trailer occurring during that period, subject to applicable law. This does not make the hirer liable for pre-existing defects or ordinary wear and tear, or for loss to the extent it is caused by Raeko's breach or negligence. This clause requires Raeko's legal review before use.
Requests depend on trailer availability. A booking is confirmed only when Raeko confirms it in writing and the agreed rental fee and deposit are settled. Raeko will state the amounts, payment method and any cancellation terms before confirmation.
Each rental lasts exactly 24 hours from the agreed collection date and time. The trailer must be returned no later than the same time the following day. The hire does not include extra time or an extension. Contacting Raeko does not extend the rental unless Raeko expressly agrees in writing.
The hirer must hold the required valid driving licence and use a roadworthy, legally suitable towing vehicle and towbar. Check the coupling, safety chain, lights, tyres and load security before departure. Follow the trailer’s rated capacity and road rules.
Use the trailer only for its intended lawful purpose. Do not overload, sublet, modify or take it outside South Africa without written permission. Keep it secured and take reasonable care to prevent theft or damage.
The hirer is responsible and liable for loss, theft or damage to the trailer while it is in their possession and must promptly tell Raeko about any incident or breakdown. The hirer may be charged for reasonable repair, replacement or recovery costs, subject to the stated exclusions and applicable law. Report theft to SAPS where required and give Raeko the case number.
Raeko and the hirer should inspect the trailer at collection and return, recording existing damage and condition. Any lawful deductions from the deposit should be explained and itemised; the balance and expected refund timing should be confirmed.
This liability and risk notice must be drawn to the customer's attention before agreement and reviewed for fairness and compliance with the Consumer Protection Act. No term here removes rights that cannot legally be waived.
